Please read these Terms of Service ("Terms") carefully before using the DycoVue platform and services.
1. 1. Agreement to Terms
By accessing or using DycoVue's AI-assisted radiology Picture Archiving and Communication System ("PACS"), you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the service.
2. Description of Service
DycoVue provides an AI-assisted radiology PACS platform designed to improve imaging access and reduce wait times. Our services include cloud-based storage for medical images, AI-assisted analysis, and communication tools for healthcare providers.
3. User Responsibilities
As a user of DycoVue, you are responsible for:
- Maintaining the confidentiality of your account credentials and preventing unauthorized access
- Ensuring that all information uploaded to the platform complies with applicable laws and regulations, including HIPAA and other healthcare privacy laws
- Obtaining proper consent from patients before uploading their medical images and information
- Using the platform in accordance with standard medical practices and not solely relying on AI-assisted analysis for diagnosis
- Reporting any suspected security breaches or unauthorized access immediately
4. Intellectual Property
The DycoVue platform, including all software, algorithms, designs, and content provided by DycoVue, is the property of DycoVue and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.
You retain all rights to the medical images and data you upload to the platform. By uploading content, you grant DycoVue a limited license to store, process, and analyze the data for the purpose of providing the service and improving our algorithms.
5. Limitations of Liability
DycoVue's AI-assisted analysis is intended to aid healthcare professionals, not replace their clinical judgment. DycoVue is not responsible for:
- Diagnostic decisions made by healthcare providers based on the platform’s analysis
- Errors or omissions in the AI analysis, which should be verified by qualified professionals
- Service interruptions due to technical issues, maintenance, or factors beyond our control
- Data loss or corruption not directly caused by our negligence
To the fullest extent permitted by law, DycoVue’s liability for damages will not exceed the fees you paid for the service in the 12 months prior to the claim.
6. Dispute Resolution
Any disputes related to these Terms or your use of DycoVue’s services must first be resolved through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association.
7. Termination
DycoVue may terminate or suspend your access to the service at any time, with or without cause or notice. Upon termination, your right to use the service ceases immediately.
You may terminate your account at any time by contacting us. After termination, we will provide your data in a standard format and delete it in accordance with our data retention policy and applicable laws.
8. Changes to Terms
DycoVue may modify these Terms at any time. Significant changes will be communicated via the platform or email. Your continued use of the service after changes are made constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
